These Terms & Conditions ("Terms") govern your access to and use of rivertrip.io ("Rivertrip," "we," "us," or "our"), including all related websites, applications, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian.
2. The Service
Rivertrip provides tools for monitoring outdoor conditions, sending alerts, and planning trips. Rivertrip does not provide guiding services, reservations, permits, transportation, or safety guarantees.
Outdoor recreation involves inherent risks. You are solely responsible for your decisions, preparation, and participation in any activity.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate information and to maintain the security of your account credentials. You are responsible for all activity under your account.
4. User Content
You may submit content such as trip details, notes, and participant information (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant Rivertrip a non-exclusive, worldwide, royalty-free license to use, host, store, process, and display such content solely to operate and improve the Service.
5. Trip Participation & Invites
When you create or join a trip, certain information may be visible to other participants. You are responsible for the accuracy of the information you provide.
Rivertrip is not responsible for disputes, injuries, cancellations, or coordination failures between participants.
6. Communications
By using the Service, you consent to receive transactional and service-related communications, including alerts and trip notifications. Marketing communications, where offered, require separate consent and may be opted out of at any time.
7. No Professional Advice
Information provided by Rivertrip is for informational purposes only and may be delayed, incomplete, or inaccurate. Rivertrip does not provide safety, legal, medical, or professional advice.
8. Prohibited Conduct
- Using the Service unlawfully or abusively
- Attempting unauthorized access to systems or accounts
- Interfering with alerts, monitoring, or infrastructure
- Submitting misleading, harmful, or infringing content
9. Intellectual Property
All content and software provided by Rivertrip, excluding User Content, are owned by Rivertrip or its licensors and are protected by intellectual property laws.
10. Third-Party Services
The Service may link to or integrate with third-party services. Rivertrip does not control and is not responsible for third-party content, policies, or practices.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required by law.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIVERTRIP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Some jurisdictions do not allow certain liability limitations. In such cases, liability will be limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Rivertrip from claims arising out of your use of the Service, your User Content, or your violation of these Terms.
15. Arbitration Agreement & Class Action Waiver
Except for limited exceptions, any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration under the Federal Arbitration Act.
Claims may be brought only on an individual basis. Class, collective, or representative actions are not permitted.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing admin@rivertrip.io.
This arbitration agreement does not prevent you from bringing issues to the attention of federal, state, or local agencies.
16. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, except as superseded by the Federal Arbitration Act.
17. Privacy
Your use of the Service is subject to our Privacy Policy. If there is a conflict regarding personal data, the Privacy Policy controls.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
